Thakur Law Firm Judgment of $2.05 Million Affirmed on Appeal

On August 15, 2023, the First District Court of Appeal in San Francisco, California affirmed the $2.05 million trial court judgment obtained by attorney Pamela Tahim Thakur of Thakur Law Firm, APC for client Kiyomi Sparks in a complex post-judgment family law, real estate, and business dispute involving the interpretation of multiple contracts. The appeal was handled collaboratively with certified appellate specialist T. Peter Pierce from Richards, Watson & Gershon.

Central to the court’s judgment was its conclusion that settlement of claims under a contract for the sale of real estate constituted a “recovery” as set forth in Kiyomi’s marital settlement agreement because the real estate sold for an amount greater than its fair market value. The court found that this recovery was community property, thereby entitling Kiyomi to one-half, or $2.05 million.

Not only did this appellate victory reinforce traditional rules of contract interpretation, but it also ensured that the equal distribution of community property upon divorce could not be circumvented through clever side deals.
